1. Scope and application of these terms
These terms govern your use of the Constrak website (constraksa.com) and any request form you submit through it. By using this site or submitting any form on it, you agree to these terms.
These terms alone do not create a construction contract or any contractual obligation to perform work. Any actual project is governed exclusively by a separate, written contract signed by both parties.
2. A website inquiry is not an accepted project
Submitting any form on this site (Start a Project, Contact, the developer capabilities-file request, or the engineering-office submission) is an initial review request only. Submitting a form does not mean Constrak has accepted the project, and does not obligate Constrak to provide a quotation, respond within any particular time, or carry out any work.
3. Submission does not create a construction contract
Submitting a form, receiving a reference number, or having our team contact you for technical review does not, by itself, create a construction contract or legal obligation on either party to carry out the project. No contractual relationship arises until a separate written contract is signed.
4. No price is final until a formal written quotation
Any price or estimate mentioned verbally, in a message, or in any illustrative content on this site (including the scope matrix and sample-report content — see the clause below) is a non-binding estimate only. No price is final or binding on Constrak until issued in a formal, signed, project-specific written quotation.
5. No scope is final until contract signature
Any description of a scope of work appearing on this site or in any pre-contract communication is general or illustrative only. The final, binding scope of a project is the scope expressly stated in the contract signed by both parties, and nothing else.
6. Submitter's responsibility for drawings and permits
You are responsible for owning, or holding the legal right to, any permit, drawing, document, or file you upload through this site's forms, and for obtaining any regulatory permit or approval your project requires from the competent authorities. Constrak is not responsible for verifying the validity, ownership, or legality of any file you upload before it is technically reviewed, nor for any regulatory violation arising from uploading a document you do not have the right to use.
7. Constrak's right to decline any project
Constrak may, at its sole discretion, decline any project request or decline to provide a quotation for it, for any technical, operational, or other reason, with no obligation to justify the decision.
8. Regulated engineering work
Constrak is a construction and execution establishment. Where regulated design or engineering approval work falls within a project's scope, it is carried out and certified by a licensed engineering office, responsible for it under a clearly defined scope and agreement.
9. Illustrative content is not a standing contractual offer
The interactive scope matrix (labor-only vs. with-materials comparison), the illustrative weekly-report sample, and any similar table or content on this site are provided for illustrative and educational purposes only — to explain generally how our scope and reporting work. This content is not a standing contractual offer, does not necessarily reflect your specific project's details, and creates no obligation to any item, price, or specific outcome shown in it.
10. Confidentiality and permitted internal review
Files and data you submit may be reviewed internally by Constrak's relevant team for technical evaluation and pricing, and may — where relevant — be shared with a licensed engineering office as described in the Privacy Policy. Outside of that, your data is not shared with any third party for any other purpose without your permission.
For the full detail on how your data is collected, used, stored, and who has access to it, see the Privacy Policy.
11. Intellectual property
This site's content (text, graphics, brand, interface design) belongs to Konst Rak Contracting Est., and may not be copied, reused, or distributed without prior written permission.
12. Governing law and dispute resolution
These terms, and your use of this site, are governed by the laws of the Kingdom of Saudi Arabia, as Constrak is a Commercial-Registration-registered establishment operating exclusively within the Kingdom.
Any dispute arising from use of this site (separate from any signed construction contract, which — if one exists — carries its own dispute-resolution terms) is subject to the jurisdiction of the competent courts of the Kingdom of Saudi Arabia.
Important notice: this specific clause — the choice of governing law and the dispute-resolution mechanism — has not yet been reviewed by a licensed legal counsel. It is a reasonable, standard default, not a legally cleared final text. It must not be relied on as final wording before review by counsel licensed in the Kingdom of Saudi Arabia.
13. Changes to these terms
Constrak may update these terms periodically. Any material update is published on this page with a new effective date, and the revision history below documents every prior version.
